Waiver

GUEST ADMISSION POLICY
Guests must be accompanied by a member in good standing to be admitted to the Club. The accompanying guest must fill the Guest
Waiver & Liability Release Form, which must be signed by the guest and presented at the check‐in gate; along with payment. All kids
under three (3) years gain entrance FREE of charge.
I, wish to bring guest(s) to use the facility owned by Greenwood Hills Community Club ("GHCC"); I recognize and understand using
that I am responsible for all actions of my guest and assure understand and abided by the Bylaws, Polices & Procedures, Rules &
Regulations & Healthy Swimming Standards. The cost of any property damage will be charged to the responsible party. Members
will be held responsible for all actions of their guests.
ASSUMPTION OF RISK
I, wish to use the facility owned by Greenwood Hills Community Club ("GHCC"); I recognize and understand using GHCC involves the
risk of injury to me or my guest, whether I or someone else causes it. Specific risks vary from one activity to another and the risks
range from minor injuries to major injuries, such as catastrophic injuries including death.
RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT
1. I understand the Bylaws, Policies & Procedures, Rules & Regulations and Healthy Swimming Standards of GHCC and will
abide by them.
2. I understand my membership unit’s Service hour obligation and will serve.
3. In consideration of my participation in the activities offered by GHCC, I understand and voluntarily accept all risks include,
but not limited to, the risk of injury resulting from possible malfunction of equipment used in the operation of the facilities
and injuries resulting from tripping or falling over obstacles on the facilities grounds and;
4. TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against GHCC, and each of their respective officers,
directors, employees, volunteers, agents and independent contractors (all of whom are hereinafter referred to as “the
Releasees”);
5. TO RELEASE THE RELEASEES from any and all liability including, without limitation, any loss, damage, injury or expense that
I may suffer or that my next of kin may suffer as a result of participation at GHCC due to any cause whatsoever, including
any ordinary or gross negligence, active or passive, of the Releasees or anyone acting on the Releasees behalf or anyone
using the facilities whether related to exercise or not;
6. TO INDEMNIFY, DEFEND AND HOLD HARMLES THE RELEASEES against any liability, damages, defense costs, including
attorneys' fees, and any other costs incurred in connection with claims for bodily injury, wrongful death or property
damage, to any third party, resulting from my, or my guest participation at GHCC, negligence or other wrongful acts or
omissions;
7. Further, I understand and acknowledge that GHCC does not manufacture fitness or other equipment at its facilities, but
purchases and/or leases equipment. I understand and acknowledge that GHCC is providing recreational services and may
not be held liable for defective products;
8. I hereby grant GHCC, their legal representatives and assigns, the irrevocable and unrestricted right to use and publish
photographs of myself or my children, or in which I(we) may be included, for editorial trade, advertising, and any other
purpose and in any manner and medium; and to alter the same without restriction. I hereby release GHCC and his or her
legal representatives and assigns from all claims and liability relating to said photographs.
9. That this Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators and assigns, in the
event of my death.
BY INITIALING THE OTHER SIDE OF THIS FORM, I ACKNOWLEDGE AND AGREE THAT I HAVE READ AND UNDERSTAND THE
FOREGOING AND KNOW THE NATURE OF THE ACTIVITIES AT GHCC AND I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY
HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS AND ASSIGNS MAY HAVE AGAINST THE RELEASEES.
